1. Definitions :-

“Platform” refers to the website https://comfortbuild.in/ and related services.

“Company,” “we,” “our,” or “us” refers to Comfortbuild Construction Private Limited.

“User,” “you,” or “your” refers to any person accessing or using the Platform.

“Services” refers to all construction, design, material supply, interior, or related services offered by Comfort Build.

The Platform is owned by Comfortbuild Construction Private Limited, registered under the Companies Act, with its office located at 5th Floor, B HUB, Maurya Lok, Patna, Bihar 800004.

By using this Platform, you agree to be bound by these Terms as well as any additional policies or agreements entered into with the Company.

3. Modifications to Terms

We may update these Terms from time to time. Updated Terms will be posted on this page, and your continued use of the Platform will imply acceptance of the updated Terms.

4. Eligibility & User Obligations

• You must be at least 18 years old to use our Services.
• You agree to provide accurate and complete information during registration and service engagement.
• You are responsible for maintaining the confidentiality of your account.
• Unauthorized use of the Platform, including attempts to hack, scrape, or disrupt services, may result in suspension or legal action.

5. Services & Payments

• All Services will be provided as per mutually agreed proposals, quotations, or contracts.
• Payments must be made as per the agreed schedule (advance, milestone, or final payment).
• Accepted payment methods will be notified by the Company.
• Late payments may attract penalties, suspension of work, or termination of Services.

6. Refund and Cancellation Policy

• Refunds are only applicable if the service has not yet commenced or if expressly agreed in writing.
• Once construction, procurement, or material delivery has started, payments are non-refundable.
• Any approved refund will be processed to the original payment method within 7–10 business days.
• Bank charges, third-party fees, or processing charges may be deducted from the refund amount.
• Cancellation requests must be made in writing to support@comfortbuild.in.

7. Warranty

• Comfort Build may provide warranties for construction quality (for example, up to 6 years structural warranty) if specified in the project contract.
• Warranties do not cover damages arising from:
  • Natural disasters, accidents, or misuse.
  • Alterations or repairs made by third parties.
  • Lack of maintenance by the client.

8. Liability Disclaimer & Limitation

• The information provided on the Platform is for general purposes. We make no warranties regarding accuracy, completeness, or fitness for a particular purpose.
• Your use of the Platform and Services is at your own risk.
• Comfort Build’s liability for any claim shall be limited to the fees paid by you to the Company for the specific service in question.
• We are not liable for indirect, incidental, or consequential damages.

9. Intellectual Property Rights

All content on the Platform, including text, graphics, logos, and designs, are owned by or licensed to Comfortbuild Construction Private Limited. Unauthorized use is strictly prohibited.

10.Termination of Services

We may suspend or terminate your access to the Platform or Services if you:

• Breach these Terms,
• Fail to make payments,
• Engage in fraudulent or unlawful activities.

11. Indemnity

You agree to indemnify and hold harmless Comfort Build, its directors, employees, and partners from any claims, losses, or damages arising from your use of the Platform or breach of these Terms.

12. Force Majeure

We will not be liable for delays or failure to perform obligations due to events beyond our reasonable control, including natural disasters, strikes, pandemics, or government restrictions.

13. Governing Law & Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of India. Any disputes will be subject to the exclusive jurisdiction of courts in Patna, Bihar.
